Details: John Penny per Surry, in the service of government, charged with defrauding a fellow prisoner of a dollar. J. Logan states I gave the prisoner a dollar to purchase some tea and sugar. He has not got me the tea or sugar and refuses to account for the dollar. C. Holmes states I saw Logan give Penny a dollar. C. Wood states, I did not see Logan give Penny any money but I heard him ask Penny to get him some sugar and it is not likely he would ask him to do that without giving him the money as they are strangers to each other. Penny is a water carrier at the gaol. I am a Wardsman there, and Logan is going from Port Macquarie to Sydney in the brig Elizabeth Henrietta and confined in the gaol while she loads. John Penny sentenced to 50 lashes
